Because orders may be transmitted electronically to a manufacturer, distributor, or fulfillment partner shortly after they are placed, Sew Nation USA may be unable to accommodate cancellation or modification requests after an order is accepted.

If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided when the order was placed.

Purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal, household, or authorized business use and are not intended for unauthorized resale or export.

We are not responsible for delays caused by manufacturers, distributors, fulfillment partners, shipping carriers, customs processing, weather conditions, labor disruptions, supply-chain interruptions, inaccurate customer information, or events outside our reasonable control.

Tracking information may take time to update after a shipping label is created. A shipping notification or tracking number does not necessarily mean that the carrier has physically received the package.

To the fullest extent permitted by applicable law, title and risk of loss pass to you when the product is transferred to the applicable shipping carrier.

SECTION 5A — MANUFACTURER AND DISTRIBUTOR FULFILLMENT

Many products sold by Sew Nation USA are shipped directly from manufacturers, distributors, or authorized fulfillment partners.

Because different products may be fulfilled from different locations:

• Items within the same order may ship separately.
• You may receive multiple shipping confirmations or tracking numbers.
• Products may arrive on different dates.
• Shipping and processing times may vary by product, manufacturer, distributor, or fulfillment location.
• Packaging may display the name or branding of the manufacturer, distributor, or fulfillment partner.
• An item shown as available may become backordered or unavailable before the supplier processes the order.

Unless otherwise disclosed during checkout or communicated to you before shipment, you will not incur additional shipping charges solely because an order is divided into multiple shipments.

If a product becomes unavailable after you place your order, we may contact you regarding an estimated availability date, an alternative product, a partial shipment, or cancellation and refund of the affected item.

The Sew Nation USA name, logo, product names, service names, designs, and slogans are trademarks or intellectual property of Sew Nation USA or its licensors. You may not use such marks without prior written permission.

Shopify’s name, logo, product names, service names, designs, and slogans are trademarks of Shopify. Other names, logos, product names, service names, designs, and slogans appearing through the services are trademarks of their respective owners.

SECTION 7 — OPTIONAL TOOLS

You may be provided with access to tools, applications, services, financing options, payment services, product configurators, chat services, or other features provided by third parties.

We may not monitor, control, or have input into those third-party tools.

You acknowledge and agree that access to such tools is provided “as is” and “as available,” without warranties, representations, conditions, or endorsements of any kind.

To the fullest extent permitted by law, we shall have no liability arising from or relating to your use of optional third-party tools.

Sew Nation USA is powered by Shopify, which enables us to provide the services to you.

However, all sales and purchases made through our store are transactions directly between you and Sew Nation USA.

By using the services, you acknowledge and agree that Shopify is not responsible for any aspect of a sale between you and Sew Nation USA, including any injury, damage, loss, dispute, refund, return, warranty claim, product issue, or delivery issue arising from a purchased product or service.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Sew Nation USA.

2. Pay compensation for Feedback.

No Agent may access, use, or interact with the services if we have requested that the Agent refrain from doing so.

We may limit, including through technical measures, whether and how an Agent accesses, uses, or interacts with the services.

14.4

Agents must:

1. Identify themselves in all HTTP or HTTPS requests and disclose the name of the Agent by including “Agent/[agent name]” in the user-agent string.
2. Not conceal or obscure that access, use, or interactions originate from an Agent.
3. Not mimic human behavior to conceal automated activity.
4. Not complete, bypass, or circumvent CAPTCHAs or other measures designed to distinguish computer use from human use.
5. Respond truthfully to questions intended to determine whether an interaction originates from a human or a computer.
6. Not circumvent or avoid measures intended to block, limit, modify, or control how Agents access, use, or interact with the services.

We may terminate this agreement or suspend, restrict, or terminate your access to the services, or any portion thereof, in our sole discretion and without notice, subject to applicable law.

You will remain responsible for all amounts due through the effective date of termination.

The following provisions will survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.

SOME JURISDICTIONS LIMIT OR PROHIBIT THE DISCLAIMER OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, SOME OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU.

Nothing in these Terms is intended to eliminate rights that cannot lawfully be waived or limited.

TO THE FULLEST EXTENT PERMITTED BY LAW, SEW NATION USA, ITS MEMBERS, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, MANUFACTURERS, DISTRIBUTORS, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER ARISING IN CONTRACT, TORT, INCLUDING NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.
